Straight pipes give the most hp gain vs after or stock pipes?

straight pipe will always give the best HP. but you will lose TQ on the low end.
but this also has to do with the size of your pipes. the stock size is 2.5'' usually if your going with staight pipes a tune is needed to help out because your car will run leaner

Engines do not need back pressure. They do need appropriately sized exhaust pipes to achieve the desired exhaust gas velocity. Most NA engines will also need tuning when drastically modifying the exhaust. It is also not a fact that you will always lose low end torque.

Yes - but only with proper tuning and the correct sized pipes. Given that not many people do custom tuning for this car/ecu, I would be more inclined to go with one of the well known setups and accompanying programming.

I watched a clip on youtube and some guy has an e92 M3 straight pipes and it sounds like shit.

Not only does it sound like shit. But a properly designed muffler and exhaust will not really restrict any hp compared to straight pipes. The biggest problem are the cats.
