Hi, I was changing my tires today and noticed that my rear passenger tire gap was lower than my rear driver side wheel gap. I can fit 2.5 fingers in the passenger gap and 5 fingers in the driver side wheel gap.

The oem wheel is the rear driver side

Usually ride height is determined by springs (unless you have adaptive suspension). Did you drive before you took the photos? The thing is that if you just lowered the car from jack stand and took photos - it will be uneven. It usually needs to be driven a bit (like even 10-20ft) to let springs/shocks settle down.
If you drove it and it's still that way - then you need to look further at tires and/or suspension.
Give us more info: what kind of suspension you have, what tires and when you put them?

What DuSh said. It scared me the first time too.
You will be ok once you drive the car around the block.

Yea, it fixed when I moved the car to the right to have more space on the left to change the tires. Well, still have to go to BMW as one my jack point fell off (don't know how that happened). Also ran over a screw in my garage and now my tire is leaking air.

My guess is you have rear air suspension. It gets a bit wonky when up on a jack and leaning back. Happened to me when I replaced the springs in the front. Had it on jack stands for a day and when I put everything back together my whole rear end was slammed. Ended up having to detach the rear links and turn the car on to force the pump to fill them with air again.

It sucks on the side of the road when you realize now you can’t get the jack from out under the car because the suspension has settled on the spare tire.

I usually lock the car, wait the 8 minutes for the electronics to turn off, then I unlock the car and the compressor lifts the rear back up.
