Kitchen sinks should NOT appear on the freeway in front of my BMW!!

This happened on my drive home last night. I was about to change lanes when this HUGE stainless sink appeared right as the truck in front of me swerved or straddled it. It happened so fast as I was doing about 65.

The damn thing wedged my bumper and became an instant brake assist, forcing me to pull off the freeway and pry the damn thing loose

My insurance will cover it but they said "We have to inform you that your premiums MIGHT be adjusted as a result of this At Fault incident." WTF?? How is it my fault that shit appears in front of me on the road ?? It's not like I have enough stopping or steering distance.

My M sport bumper is broken, my fog lamp is gone and my TPMS indicates a problem although pressure measured OK.

i don't know the insurance rules or laws in ca but in ma, i had something similar happen to me, not in my bmw but in another car years ago, quite expensive fix since it involved replacing the motor...anyways, i went through insurance, they covered it...at first they will increase your premium but you can appeal the surcharge and if your found less than 50% at fault, then your premium will go back down and insurance co. will adjust your balance and pay you back any money owed on the surcharge from the initial date of surcharge increase...good luck, hope this helps...

They consider deer and stationary objects to be different. That's why I don't get that guy with the deer, he wants pdr instead of fixing his car for 4k. He was so influenced by the wrong information on this forum, yet if he would contact his agent, he'd get an opposite response that was given here. Smart people don't ask a bunch of total strangers on a forum for advice, they ask someone who knows for fact. Like the OP here.

If you go under collision insurance - then the accident is deemed your fault by your insurance company. The assigned fault refers to the "safe speed for conditions" section of the Kalifornia Traffic laws i.e. if you were traveling at a safe speed (whatever that means) then you would have avoided the object.

Thus, you want the accident to go under the comprehensive clause in your insurance policy - if you have one.

You're on the right track...collision. Whereas the deer is comp--the deer can run into your car or in front of you. As silly as it sounds, the kitchen sink was sitting there in the middle of the road, i.e. the motorists' fault.

I had something similar happened to my 750i few years ago. Had to have the bumper painted and the subframe replaced. Geico paid for it, minus the deductable. They didn't rasie my rate.

I believe that would be different, because the other guy should not be having objects falling off his vehicle. Technically it's his fault.

What is it with stainless steel sinks in the middle of a freeway lane. Just saw this same thing a week ago on a freeway I was traveling on, 60mph and wow there out of nowhere appears a stainless steel sink. Luckily I saw it and swerved to miss it. Certainly not the oddest thing I have seen on or along side the freeway, saw an fiberglass extension ladder laying parallel to the lane in the passing lane a few months back. Who are these idiots that manage to loose these things??????

whoa, that sucks!

it probably could have been much worse if it went under your car and you continued all the way over it... or you swerved and made a bad situation worse...

Probably a contrator with a dump load that wasn't secured right.

Good luck with the insurance. I had what I thought was a rock the size of my fist hit my windshield once. Turned out to me manure from the semi a few cars ahead. Still chipped my windshield though. ) :
