Second accident in 2 month

Hi guys,

I am having a bad luck and a couple of days ago I had my second accident in 2 month. This time someone backed into my parked car and smashed the front passenger fender and a little bit of front passenger door. I was lucky to catch the guy who did this and he admitted the fault. His insurance supposed to cover the damage but they don't want to cover the cost for OEM fender.
Also, their adjuster saying that the fender can be repaired or replaced and painted and the door also need to be repainted to blend the color. The question is what will be the better option? Repair or replace the fender? And if the insurance won’t cover OEM fender what are the options? The car is 2007328i sedan. They are saying that the car is too old for OEM parts.

Just bring it to a BMW Certified Collision center and have them deal with the insurance. Best of luck to you...

Always best to get a new part rather than have the old repaired. The damage will be slightly visible no matter how well it's done. New part will be OEM and will look like nothing ever happened. Especially for a Bimmer. Best of luck to you, man.

Atleast you caught the guy someone backed into my bumper with a toe hook never found out who did it, they damaged the bumper, Grille and chipped the hood, I haven't found out yet what the repair will cost but I ordered the bumper already and Grille not sure what the repair on the hood will be but I am assuming it can be repaired.

why are you dealing with their insurance?

deal with YOUR insurance, get your adjuster. File a police report. then your insurance deals with their insurance.

the name of the game is to put you back into the same condition you was in before the accident. that includes the use of whatever original, OEM part that was on there.


wait, you are not an uninsured motorist are you?????

+ 1 and tell them you only want it repaired BMW Certified Collision center. Then you ask them about the resale value of a wecked BMW...

i opened the claim the next day after the accident with my insurance also and my insurance claim adjuster recommended to deal directly with at-fault insurance company directly. In this case i will not have to pay deductible.
He told me yesterday that the other driver admitted the fault and if i have any problems in the future to just let him know. i just don't know if it's better to deal with my insurance or directly with at-fault insurance.

Anyway, thank you guys for your reply's, this really give me some ideas.

In the same boat, had 2 accidents within 2 months, 1st time the lady didn't have insurance, my attorney is going after her hard, 2nd one just occurred 3 days ago in the 10e freeway guy side swiped me on the left quarter panel and cracked my bbs lm's and f'ed up left side -_- soo annoyed because we have the same insurance company so they are probably going to try to low ball but I have my attorney on this case as well. It always helps to have an attorney to make them replace oem parts, I'm hoping my car is totaled so I can just upgrade,,,

take it to the dealer and have them fight for you. They did with me for the the amount of 9,700.00, they got my back 100% against my own state farm insurance, I have a almost new engine.

Using non OEM parts will just devaluate your car and cause fitment issues. I would fight for OEM parts and proper repair. Best thing to do is get an independent appraisal/estimate.

If your in U.S. you deal with the at-fault insurer and Canada is your own insurer.

In your place, I would have my insurance company take care of all the damages. They will fix it up and charge you a deductible, but then go after the other party, retrieve the money, and repay you the deductible. Less hassle this way, and as long as they get compensated, your provider will not raise your car insurance quote.

definitely OEM parts. all BMW CCRC's must abide by this and are not allowed (per bmw NA) to use non OEM parts. replace is better than repair, if they do a nice job it will be undetectable repair.

Seriously? I hear this more and more often, but have never been asked to take that course of action. Last accident 6 months ago (recent) which was not my fault, I never ONCE spoke to the other insurance company. Never paid a dime.

Push for OEM parts. They will push back.
