Possible transmission leak
Recently I have noticed my car hesitating while shifting once in a while but I just attributed it to the cold weather. While working on my car today I noticed a leak.
From the looks of it the fluid seems to be leaking from the back and moving forward. I know about the service bulletin for bad tranny gaskets and would just like to see if anyone knows if this is a tranny leak for sure before I call the dealer in the next few days. Is this something that bmw would fix out of warranty because of the bulletin?

Possibly a Leaking Mechatronic Sealing Sleeve. Known issue on ZF 6HP Transmissions.
Had mine repaired under warranty. Not sure if BMW will repair as a warranty item if you are beyond the original warranty. Also, If in fact it is the seal, BMW does not replace the pan/filter or the fluid. They only top off the fluid when they make the repair. If you want the fluid/filter change, BMW will charge for it. Also, Try searching Mechatronic Sealing Seal, number of threads regarding this issue. See attached TSB

Get this taken care of ASAP. Who knows how long it has been leaking.

If no codes are being thrown use Chevron Techron fuel injector cleaner (concentrate). It solves rpm fluctuating upon cold start-up. Also, for most BMW problems start off by scanning your car with the Peake Research Tool. It contains the actual BMW codes. If you want to register a newly installed battery for free (just buy a $10 cable) and google/download BMWLogger

Thanks for the help, had no idea about the mechatronic issue. At this point, approaching 50k miles, I might as well just go ahead and replace all the fluid, oil pan, and then the mechantronic seal.
I'm lucky I have access to a lift, can't image trying to do this on jack stands.

normally the mechatronic problem shows up when the car has sat up for several days
and you shouldmcheck with these guys on a pan/filter. http://www.thectsc.com/index.php?p=p...=187&parent=43

If you have any warranty left take it back to the dealership. If not you can do it yourself for approximately $300 if I remember right, and a couple I hours. I did mine I change the sleeve, trams pan and oil and now everything is working just fine.
