Exclamation So what happens when a new BMW is in the shop for over a month?

I remember reading a post somewhere on here from a person that had a major problem with their 335i and it ended up being in the shop for over a month. As part of that post I though I remember the OP saying that if the car is in for repairs over a month BMW makes a huge gesture i.e. offer replacement car or money back.

Does anyone know of this policy or something like it when a car is at the dealer over a month?

I dont know about BMW but the lemon law in some states says that after x days in the shop the car is classified as a lemon

in CA after 30 days you can file a lemon law case, and the mfg. is responsible for an equivelent replacment.
happen to my customers 06 S4, and Audi gave him an 07 twin.

Usually the car has to be in the shop for the same problem multiple times (say three times for X problem) OR if it is in the shop for 30+ consecutive days, a lemon law is likely going to come into play.

Usually, when the company knows that they have a lemon on their hands, you can circumvent the entire lemon law process and they can give you a new car. VW did this for me three years ago--my car was at the dealer for about 4 weeks--it kept stalling randomly. It would always start back up, but they could not figure out what was wrong with it--they tried everything under the sun, but nothing kept it from happening. They thought they had fixed it, and I was getting on the interstate to head home when it stalled again--that seemed to be the last straw, and they gave me a new car. Stayed in the original K too, which gave me a decent amount of equity in the replacement vehicle, allowing me to get my 1st E92 for a lower price. So sometimes, it can work out ok.

Hopefully your dealer has you in a BMW service loaner car. If not, you should talk to your service manager to get you in one. 2nd of all, if you are in a loaner, see if your service manager can contact his FSE (field service engineer) if they could reimburse your monthly lease or car payment for the lenghtly time your car was in the shop. BMW will usually cover this in some way. Either a payment, detail service, or an accessory installed for your inconvenience.

^Huh, that's good to know. The longest we've been without the car is 2 weeks while it was in the shop. That was after already waiting for parts for a few weeks.
Total I think it's been in for about 18 days now for the engine lifter/ camshaft/ problem.
They fixed it and it didn't last a week. I've been increasingly worried, since this is the 4th time now they will be looking at the car..

How good is BMW about taking care of you in these situations? The only person I personally know that had an pretty straight forward case had a lemon VW. Another friend w/ a bad BMW had to hire a lawyer in order to get them to comply (here in Cali)...

In CA it doesn't matter. As long as it's "out of service" it counts towards the 30 days.

My CTS-V spent time in the shop waiting for a part and that helped my lemon law case against GM.

I'm not sure why it would matter that the dealer is "waiting on a part." If that was a legal loophole then what about 45 days? 60? A dealer could just say they are waiting on a part which really undermines the whole spirit of the lemon law. I think car companies are strictly held to 30 days, be it they are waiting on a part or the chief engineer is on a honeymoon on Mars, or the service dept is so backed up they have cars lined up all the way Germany. No excuses, just fix the dang car or gimme a new one that works like its supposed to.

i know my friend's 335i has been in the shop for 2 months now because of the failed fuel pump. He had them pay for the payments he owes for the last two months..that helps alot, plus he has a loaner. Maybe your dealer can do that?
