Cars can sit on the lot for a while, not really a huge deal though. If anything, you avoided some of the recent BMW cost cutting.

My dealership quit ordering 6MT 335i's unless the customer orders one since they said the last one they had sat on the lot for 8 months before being sold.

My 335 sat for 11 months.
I bought my new '08 last month and the build date is 7/08.
The dealer had two new 08's.
I just change the oil and filter with 500 miles on it because the oil has been in the engine a year or more.
No problems....yet and just under $10K off the sticker.

Dealers like to move their cars within 3-4 months. Yes 10 months at a dealership lot is definitely excessive... and I believe that explains the issues you're having. Pay close attention to tires cuz they can easily go bad if not driven for that long.

Mine was at the dealer for 4 months, but rolled off the line 8 months before I bought it. In that time, it had less than 5 miles put on it, but it has been far from issue-free.... My Disco (LR/Jag are notorious for electrical issues) never had any problems, but my 335 has had all sorts of shit wrong with it.

I personally think mine sat on the lot for months because of the craptastic orange peel factory paint job.

Might have been damaged on the boat, then the dealership got it repaired and repainted when it arrived. The factory paint job usually isn't too bad on orange peel IMO.

Well, in all fairness, the paint isn't THAT bad, and it's pretty much the entire car, so unless it was hailed on, keyed on every body panel, something like that... Then I don't think it was a repaint. Plus, it passed the bondo check test, so it couldn't have been badly damaged. I know there was one boat back in Jan 08 where a bunch of our cars came loose and very physically intense relations with each other, but I checked and my car, although produced in Jan, didn't board the boat until late April or early May, I believe.

Anyway, a lot of owners on here have mentioned the below-expected quality of the factory paint jobs. It's definitely something that's been discussed frequently on this board.

For as much as these cars cost, the orange peel paint job bites it. They shouldn't have any, I should have complained when BMW sent me a "what can we do to improve".

Never had any problems with BMW paint...then again I came from a line of Hondas prior to moving on to BMW's. And Honda's have the softest paint you can ever imagine. Its a detailer's nighmare. So compared to them BMW paint rules. Can take quite a beating, love it so far.

My new '08 was a leftover and that's why I got a big discount.
I'm sorry but I don't understand the rest of your post.

One defect really isn't a big deal and is not a lemon.See if you have more problems.
There are lemon laws and I don't know what Canada's are but don't worry with only one incident.

My factory paint on my E92 has the worst orange peel I ever see... well not include the big 3 junk of course. And I take delivery my E92 2 days after it arrive Toronto so there will be no chance the dealer to repaint it.

I disagree. Cadillac has the best factory paint job I have ever seen. Consistently every time I see a metallic black CTS-V, I basically see a moving piece of mirror.. the reflection is so clear it makes my jaw drop and wonder why BMW can't do the same thing.
