Really?!

So a few days ago I put down the deposit on a alpine white with saddle interior 328i coupe. car was fully loaded (minus heated seats and navi) and had 32k miles. After speaking with the sales people and negotiating for a few days I got the price from $25,880 to 24,500. After I put down the deposit I got the order form and found out the car actually had 35,500 miles on it. When I called the dealership they said an employee at the place was driving it and had put the extra miles on. Apparently someone "forgot" to update the miles on autotrader and the dealerships website. After speaking to the dealership the sales people pretty much told me tough luck and that 3k miles wasn't that much anyway, and it doesn't matter anymore cause I already put down my deposit. When I spoke to the manager of the place (who avoided taking my calls or calling me back for about a week) I told him I wanted the car at $24k even or I was walking and he told me I was being unfair and that they will just return my deposit. This was my first time trying to buy a car I saw online and just want to know if this is how they do business. BTW, I'm in the market for a 328 or 335 coupe if anyone has seen anything good (and legit!).

I agree that an extra 3k miles is outrageous - if it were brand new. It's not exactly a huge amount now, but even though, you do deserve the real mileage and i'm pretty sure that was not legally correct of them to do (don't count on me though, I have no real knowledge of these things).

Same goes for the 500 dollars. You should have asked for more off in the first place, because asking for 500 dollars off now just makes you look like a sissy. This is just my opinion though.

BMW dealers are assbags, especially when it comes to negotiating prices. Gotta pick your price and cast a wide net. Somebody will agree and you'll find a good deal. I had problems because my local dealer told me they were up 3% in sales from the prior year.

That SUCKS !

I would have told them I wanted the car for 23k , and DEMANDED to speak to the owner. I would have continued on by asking them if they always do business that way, yadda, yadda, yadda.

Thats just a sign for you to stay away from that dealership ... Imagine what will happen when the warranty they told you about was a "mistake" also.

Search around, 328's and 335's are not that hard to find, from a reputable dealership. Really, look on e90post.com and you likely find what you want.

Since the mileage on the car was misrepresented, the deal you made is null and void. You have the absolute right to get your deposit back and walk away. However, the dealer also has the right to choose not to sell the car to you at some lower price that you make up. Walking in and demanding a lower price probably isn't going to work. Just go somewhere else.

Regardless of the brand, there are good dealers and douchebags around. Just go somewhere else.

walk away...its not that hard to find good deals on the 328 at that price range..im sure they'll work out something better in return if you just walk away. Dealers are like that. Act tough.

The sales process is where you're supposed to be treated like royalty, especially in this economy. They should be begging you to take a car off their lot. Just imagine their attitude AFTER they've taken your $23k. Walk away.

Walk away buddy! They are treating like this without buying a car from them. Imagine once you sign papers. They are lot more cars out there than you might think. Or even better just wait another three more months and you will more options, cuz everybody is hurting in this economy.

I was in the same situation but with about 4k more than advertised, but I didn't want to cause problems since you'll want a good relationship with the dealer if anything were to go wrong.

But that's a totally awesome, non-intrusive way to do it. Tell them this is what BMW charges its customers, so you're generous enough to forget $200 and round it off.
