It's in the E-Sys cheat sheets. If it's not in the regular Bimmercode menu you'll have to use the expert mode and find the appropriate item per the cheat sheet.

If you blind anyone with your fogs you've got them aimed wrong. The reason why they don't stay on normally with high beams is a practical one. If you have your high beams on your sight line is well ahead of the car, where the fogs have no effect, if they're correctly aimed. In order to minimize the drain on the electrical system BMW made the sensible decision to leave the fogs off when they're not doing anything useful.

It's been like that since 2001 when I had a E46 and Mini Cooper that used one bulb for both the hi/low beam, it "drains" the same amount of power at all times.

A mechanical flap controls the hi/low output, so your claim that it's to "minimize the drain on the electrical system" is unfounded.

The fog light is restricted from powering on with the high beam so it doesn't glare uncoming drivers, which is the number one compliant to the Federal Motor Vehicle Safety Standards in the US.

That's not going to happen with separate fogs. As for the steps that BMW takes to minimize current draw, I see them throughout the car. One doesn't have to be an electrical engineer to notice them, but since I am an electrical engineer its impossible for me to not.

It is for legal compliance with the “no more than 4 forward white lights” rule and has been that way since the e34 at least for US spec cars. All manufacturers selling in the US do this. My DSM, my Tahoe, every Bimmer that has factory fogs, etc.
It certainly does help fill just as much with the highs as with lows, so I also coded /modded it on every fog equipped car I have owned for the past 30 years.
