Unhappy 1-series vs Prius. Who's at fault?

It looks like the 1-series was racing a Corvette or something, which is why there were people filming it. I think the Prius is 100% at fault for lane hopping and failing to yield. I concede that the bimmer was exceeding the speed limit (reckless driving?), though I don't know by how much. I think the blanket explanation, though, is that in an accident that involves a Prius, the Prius is always to blame.

Both are at fault IMO. BMW was going way too fast. he had time to brake and swerve into the other lane too, although clearly the Prius driver should have been more observant.

Regardless, most likely the cops who arrive at the scene/ the judge dealing with this case will place the BMW driver at fault simply because he was speeding. similar case with my friend who was going over 100KM/H through a yellow light and some lady in a Mazda turned left at the light without checking first. He was deemed 100% at fault.

With video/witness evidence of it not being a standard texting-while-driving-rear-ender, this type of accident would default to being the Prius's fault, since they failed to yield when entering traffic and changing into the left lane.

However the Prius's lawyer could do the math on how fast the BMW was driving past the lane markers and calculate its MPH. Then prove that its speed was so excessive, it was not possible for the Prius to have anticipated/seen it coming so fast from so far away. If they can do both those, a reasonable accident investigator might assign 100% fault to the BMW.

Accidents are the responsible of all parties involved to avoid whenever possible. I think this one was pretty inevitable, given the BMW's speed and the Prius's illegal entry and lane change. With split second reflexes, it looks like the BMW could have seen it coming and swerved into the right lane though. Just sayin.

Looks unlikely that anyone was seriously injured, and that's what really counts.

What we can’t see is did the Prius stop at the stop sign? From the IG video it looks like he might have ran the stop sign?

both at fault. BMW excessive speed and Toyota failed to maintain his lane. EVERYONE knows you enter into the closest lane not cross one lane to the other when entering a priority road...

BMW drivers like this are the reason for common BMW generalizations. There is no way for The Perius to be able to see the BMW going that fast. To makes matters worse Perius view was obstructed by the other vehicle.

Yup, but he didn’t do either...

Both could have avoided the accident. I think both are at fault.

Something tells me the Prius intentionally cut off the BMW.

I see this crap all the time here in FL from tourist.
Prius' fault all the way, when turning at a light or a stop sign you have to enter in the lane closest to you (right lane in this instance). Then check the lane you are wanting to enter before changing lanes.
Prius tried to enter the highway in combination with a 2 lane change. 1series should have dove inside though.

Maybe the 1er didn't change lanes because he thought the Prius was just swinging too wide into the left lane and was going to "correct". Definitely Prius at fault, though.

You pretty much just described 95% of all MILF drivers. They are all fucking clueless and oblivious to their surroundings, or some of them are aware of their surroundings but just don't give a shit about anyone else but themselves.

In the northeast, typical MILF cars are the Lexus RX350, Acura MDX, Toyota Sienna, Honda Odyssey, Honda Pilot, Toyota Highlanders, BMW X3/X5, Mercedes GLK/GLC/ML/GLE, and if their husbands have a little more money, maybe a Ranger Rover.

after the prius driver went for the right turn , he changed to the other lane because he thought the first car ( on the right) was coming fast , so he tried to avoid having the car on the right brake hard or hit him but he did not see the BMW coming on the other lane , mainly because the BMW was coming too fast

People do it all the time , they turn to the closest lane , then they realized the car behind them is coming fast and they do not want to accelerate so they go to the other lane to let the car passed.

Problem here is the BMW was going to damn fast so the prius driver did not anticipate. This happens all the time with bikes, hard to judge how fast they are coming.

To me this is mostly BMW faults, here is the reason why , lets say the prius driver is in the wrong , the accident could've easily be avoided if the bmw was not going that fast , easily

Here is a lesson for the street racers , if you are going to be a moron and start racing on the street you better assume nobody sees you , this is because nobody is expecting cars to go double the speed limit. If you drive aggressive , you better be aware of your surroundings and be ready to either brake or steer away from danger

I’m still convinced it’s 50/50. Could have been avoided if BMW wasnt flying, but all the Prius driver had to do was just be a touch more observant.

Plus the BMW had space to swerve around. He didn’t even bother to brake? Clearly the Prius driver wasn’t expecting someone to be flying on this road, but the road looks very open and safe for driving faster which would automatically alert a good driver to be more observant. Lots of factors at play here, but Prius driver was deemed at fault although It could have went both ways.
