Traffic ticket help

Sup fellas,

Need a little help here, my dad got a ticket last week for "unsafe lane change" while driving my beater exiting the belt pkwy. He's under my insurance policy, wondering if this will affect my insurance rate?

Dad is 71yo and has never gotten a summons before, claims he wasn't speeding and used turn signals while changing lanes to exit.

I dont know about NY but in NJ they will let you slide on the points, 1 offense per every 5 years I believe.

What a dick cop....guaranteed there are far more dangerous drivers that he could have been pulling over instead of "unsafe lane change." Granted your father was honest about, signal lights etc...

I witness some of the most retarded aggressive drivers here on the highways here in NY, passing on the right, passing in the merging lanes...etc

It's def a bullshit ticket, not sure what to do Thinking of fighting it, but if there's no points I would just have him plead guilty and pay the fine.

Well technically speaking, "unsafe lane changing" falls under the category of a moving violation which is subject to points as per NYS law. What it breaks down to is, yes the signal was used and it wasn't over the speed limit, however the officer felt it was an unsafe move, this could be constituted by a whole list of things anywhere from not a safe distance between the vehicle in which the defendant was entering or to how many feet went by before the turn signal was used. However, i would contest the ticket and when/ if they give you a court date, show up "professionally dressed" and explain to the judge the situation. 90% of the time, if the officer even shows up, they will favor the defendant as long as you don't have a bs story.

As far as the cop, I'm sure he was a dick, most highway cops are but being the son of a NYPD highway cop and former NYPD officer has helped me learn the laws of the road.

So to make it short and sweet, yes its susceptible to points, thats at the discrepancy of the judge, yes if points are assessed it will increase your insurance rates in addition to adding points to your father's license. BUT if the ticket is dismissed your all in the clear.
