Bought a 3.46, got a 3.08..

Hello all,

If this is in the wrong section i apologize. I wanted your opinions and advice for what i should do. I recently on August 29th bought a used Quaife LSD with 3.46 gearing from this forum from JMARS here: http://www.e90post.com/forums/showth...ghlight=quaife

He was very friendly and assured me the 3.46 ran well in his car and would bolt right up in my 07 6speed. I bought the LSD knowing it was still on his car but it took over two weeks to finally receive the LSD after payment, no biggie, was in middle of getting married. After returning from our honeymoon and getting settled in to our new house, i found time to install the LSD. I installed it on Tuesday, October 21st. Car drove fine, no noises, etc. But the final drive felt no different than the stock 3.08. So i looked up a gearing calculator for my tire size, and it indeed my mph/rpm concluded that it was indeed a 3.08. I also did some top speed tests in 3rd gear and it was the same as stock.

I contacted JMARS who assured me it was a 3.46, i sent him pics and videos of my tire size, different speeds showing rpm, etc. He then told me he would have to talk to FFTEC because they did the install. Here's their first response "It was a custom quaife final drive in between the 3.08 and 3.46 to eliminate last gear shift for 1/4 mile." JMARS explained he ordered it through Shiv, and was told it was an auto. He agreed that i was correct in saying, i did not receive the 3.46 i paid for. He sent me more texts saying Shiv insisted it was a 3.46. FFTEC told him that they installed what Shiv gave them, which he says is a 3.46. However, the differential i have in my car is certainly not a 3.46. JMARS offered me $200 to settle the dispute. However, i am still awaiting a response from him currently.

What should i do? I wouldn't have bought the diff if i knew it was a 3.08. (I don't care if you think 3.08 is the better final drive, i bought a 3.46 and didn't receive what i bought)

I'd keep it. $200 off is fair. If you really don't like the 3.08 then send it back. You'll lose time and money or you'll lose out on your diff of choice and get $200 off.

Edit: Or sell it to me for not many dollarbucks and buy a different 3.46.

Well, now i've been told by him that he can't give me anything for a few months. I can't send it back as it's been 45 days since the payment, even though it didn't get shipped out for a few weeks.

JMARS has an Auto, which for his car it would be a 3.46 gear. An MT is 3.08. Did you buy the whole differential from him, with the ring gears, or just the LSD itself? The LSD itself isn't going to change your final drive from 3.08 to 3.46.

He said he's had 4 different 335i's with LSD's, but the one he sold me was supposedly a full 3.46 quaife pumpkin off a 07 manual.

Ah - so it was the whole pumpkin? If off an '07 manual, it would definitely be a 3.08. His for sale thread said it was off an Automatic, which would be 3.46. I guess he didn't verify it like you did - good on you.

The LSD itself is the same for either.

Yes, the for sale thread was for a 3.46 whole pumpkin with a Quaife, i clearly received a 3.08.

I don't blame you for wanting your money back in full then. I think he was the one that was deceived originally, and was sold a stock MT diff. Just didn't know until you actually verified it.

Guys I have been on here for ever! And I have never scammed ANYONE! Unfortunately when I bought this I was told it was an AUTO diff to eliminate that last shift right before the traps at the track, I was not as smart as Elijah to verify this. I could understand the frustration but i'm trying do don't he best I can to correct the issue. I need a little faith...
I just want to point out that I've never gone MIA on OP also I've been keeping in communication.

JMARS you're right man, you have been communicating, but i need a little more than that. We agreed on what would make me happy and even though you didn't do it on purpose, it's your responsibility as the seller to make it right.

Sounds like you were sold one thing, and received another thing. This is rather black and white unless there's some context we are missing here.

He can't send OP $200 due to a lack of cash flow? The E90 build is easily $15-20K, this makes no sense at all.

Not my place to resolve a dispute between two private parties, but this doesn't pass the eye test.

TBH your biggest mistake was buying anything that Shiv has been associated with.

I could tell reading earlier in this thread you wouldn't see your $200. Doing an expensive build and just selling the diff means the guy shouldn't have an issue coming up with $200.

How does one not know they have a 3.08 instead of a 3.46? Your speedo is going to noticeably different plus the car will drive differently. Unless he never ran in.

just keep it as its still a really good drive that your be able to sell quickly if you truely didnt want it. it really just sounds like their was a confusion on what the drive is....

wouldn't you have to recalibrate the dash when changing the drive etc?

This all doesnt make sense as Jmars should have easily been able to tell it was not a 3.46 especially for someone who is building a nice car. He drives it hard im sure and anyone that drives and does upgrading to cars are pretty sensitive to even small changes which this is not. 3.46 to 3.08 is a huge difference especially in acceleration and if he did truly drive it after he installed it then he would have known a huge decrease in acceleration.

Tell you the truth I think he knew about it and didnt want it which is why he sold it. Also he might not have $200 lol...spending all that money on his car could have come from all his credit cards. Just because you are doing a crazy build doesnt mean you have a ton of money all the time lol. He probably maxed out his credit cards and really doesnt have money...who knows...but if he did have money im pretty sure he would have sent you $200 to just end the dispute as anyone financially smart would do this.

Doesnt seem like you are going to get that $200, but if you could thats the route I would go and call it a day unless this is your track car and nothing but track. If you daily drive it I wouldnt worry about the 3.46.

Even if it took years to build that car, that's a five-figure build without breaking a sweat. Anyone dumping that type of money into a car either has the cash flow, or is monumentally irresponsible with their money.

Car has a carbon driveshaft, full JRZ suspension, full M3 conversion, BBK...Definition of a track-specific build.

I guess it just hurts my head to think someone would put all that on credit, knowing full well they lack the cash flow to pay it off. Oh well his personal finances are irrelevant, bottom line is he's dodging OP over relative pennies on the dollar.

Easy answer for the OP... The seller committed fraud. Call your bank, call the police, take him to small claims court. You can't just complain about something and not take action. Only wives are allowed do that

Thats true, but im in the market to buy a 4runner or fj cruiser and talking with salemen there are way more irresponsible people out there. A used car salesman told me that he signed someone up to buy a $35k truck at 24.99% apr for 72 months to fit his budget lol. I almost threw up in my mouth hearing that...so there are people who can afford to pay the cc bills consistently, but just all broken up and not all at once.

I mean ive put a ton of money into my car too and I can see how someone would just want to keep upgrading no matter what the costs lol. I dont even track much and ive put in more than jmars I think and all because I just love working on my car and upgrading parts lol. It does seem stupid now that I might get rid of the car, but not too many regrets.
