Cancelling an Order?
Anyone got any experience trying to cancel an order?
I was supposed to have my car this week. Then it was pushed to the end of October now it's back in November. Yes it looks like it's the old M Sport Brakes. I sold my car on the basis on the initial delivery date and I'm currently carless :-( It's not helped by the fact that looking around I can get a better deal. I know it's just pure frustration but the lack of communication doesn't help. |

Its rare they will commit to an exact delivery date. They will merely indicate an "anticipated" delivery date.

Of course they won't commit to an exact delivery date!
The contract is deliberately written to give them flexibility on the delivery date. You can cancel any time, but would need to negotiate any deposit return. |

Yes they've been very careful about delivery date. I have a lot of communication in email but all discussion of delivery date has been over the phone in person.
There's also the fact that they have never actively informed me of a delivery date I've always had to ask. Even the delays. |

I've asked about the possibility of cancelling citing the delays so I'll see what they say. Might go get a Golf R |

Currently away from home so cannot check wording.. But pretty sure that my contract had expected delivery date and small print on reverse said I could cancel if not to arrive within so many weeks of that - 4/6/8?

I'm in a similar position and had this conversation with my dealer (Partridge Hampshire) earlier today. I placed my order for a 330D Touring with Pro Nav/ Visibility pack/ Adaptive suspension & M Sports + pack on 5th August. I was originally quoted an estimated delivery date of 10th October but this has now slipped back to a week 46 build and a week 49 delivery (just before Christmas!).
My dealer stated that they wanted to keep their customers happy and if I chose to cancel my order, they would refund my £2K deposit without question. I am currently considering whether or not to cancel and a fuller story is subject to another thread/post. |

Read the back of your contract, it's very simple, but you have to wait until 30 days past the estimated delivery date at the time of order. Then you can give them 7-day terms; either they deliver the car or return the deposit in full.
They are going to want the order so if you're not happy with the deal then you can use this as a bargaining tool before the 30 days is up - they'll know if they can't deliver and want to avoid that outcome - although personally I ended up giving notice and got a call that met my demands the next day Either get more discount or a courtesy car, nothing less! |

Have you explained the situation to the dealer and how due to their lack of delivery, you will need to cancel the order unless they can provide a loan car.
This is what I would have been looking for if mine had slipped further. |

I cancelled my order today, 335d ordered Week 29, told today that build week is now week 49, with delivery by Christmas. I can't wait over 5 months. They have agreed (verbally) to a full refund.

I would imagine most dealers would just cancel it and refund you as they wouldn't want the bad press, maybe you can get a good deal out of this on a different car without m sport brakes, it must be a 3/4 series problem as my M135i will be here mid October

I could be wrong but in the T&C's on the back of the invoice I'm sure it says if the delay is more than 42 days (something like that) then you can cancel for a full refund of your deposit. My delays were a little different when I cancelled and reordered from elsewhere.

They are options on normal F3x, not on M135i. The brake company will not get into a position to stop supply on a 'contractual' part, ie. M135i.

I was lucky I guess (read my posts from around 12 months ago if you need more detail) because my dealer gave me 2 cars during the long wait for my car
Just have a chat with them and see... PS, Don't get a bloody Golf R!!! I don't get why people would want a Golf after expecting a 3 series beemer??? - Don't answer that BTW |

I have been told that if the purchase is linked to a finance agreement and the order hasn't gone into production then you are fully within your rights to cancel. Regardless of what the contract says. We'll see. |
