They have to make it right... This also can be settled quite easily - "hey GM, mistakes happen I understand... But I'm not paying more for a vehicle when I was happy with this one... Find me just like it or one to my color specs and just get me a bitching deal on it, give me some documents that you'll honor this and I'll happily bring this car back to you..."

I've seen dealerships do more for less problems... Infinite vs finite - most dealerships (at least the ones run right) understand the importance of repeat business and referrals...

Lease Documents in Hand, signed by dealer, pay the monthly fee, and drive it. If they come to get it back by force it would be Grand Theft Auto.

I’m sorry for the late response guys. I’m absolutely LIVID.

I was promised they would get me another m5 for the same price and this one would be better (it has ccb). They said it would be in Friday August 9th and if I could bring in the car that day (this was happening on the 8th) because they really need the car back. They promised the replacement would be in the next day and it would mean a lot for them to get the car back now. I trusted them and brought it in. BIG MISTAKE. Don’t ever trust salesmen no matter how close you think you are to them.

Long story short they said the car was delayed and I went back and forth with the sales man for a week. When i finally went back in last week in person her ignored me while I waited at bmw for over an hour. I got a text message saying he’s been super busy and trying to locate a car. Now it’s straight radio silence.

The car is for sale !!!! Also dealership is park ave bmw. Don’t deal with those liars.

If anyone knows what other options i have please lmk. I have copies of the lease agreement , the sales order , and even the books /window sticker of the car showing the vin of the car.

Car Fax shows it was a lease back in 2018 and then Park Ave took it and sold it on 07/24 (assuming that was you). Honestly the only thing I can see from this is that they could not secure lease approval and had to unwind it. I wish I could access BMWFS's LOS portal to see. Did the ever run an inquiry on you (dont remember if you stated that)? But if they didnt approve you on the lease, by law they are required to send you an adverse action letter with reasons.

Edit: and a title was issued based on the 07/24 sale.... who was that?

That’s right, I picked up on the 23rd (at night). I’m not sure if they ran an inquiry but took my social and all necessary info. And nothing was there about me not getting approved. I have a perfect credit score with more than amazing debt/income.

It is a 2018 , they said it was an exec demo and could be leased.

Not to mention the lease document was all signed and dated

Something I would push for is for them to write up paperwork before the 30 day period runs out or they will need to re run your credit again for the "new" new car lease.

How did they even try to lease a 2018? Lease support has long ended. My guess is they thought they'd get an exception from BMW, leased the car out, got rejected and now unwinding the deal.

I'd hold off on getting a lawyer involved. Or rather, talk to your lawyer so you're informed, but don't throw legal stuff at BMW just yet. If you do, they'll probably clam up. Instead, try to resolve it with PA and BMWNA on your own first. If that doesn't work, then bring the suits in. If it gets to it, I'd also tell them you'll take this to the Better Business Bureau and the media. I doubt however many $k the dealer will lose to make you happy is worth the trouble for them otherwise.

forgot to mention, you need to speak to the manager of the dealership. stop talking to the salesman.

They can get approval from BMW FS to lease 2018 model years with low miles. My dealership has done that several times that I know of. soooma got a Macao Blue M5 on a lease in this fashion.

Yep... I guess we all are using supposition here but a lease contract is binding unless the dealer sent a letter of rescission (state dependent) so in effect if this was the case the dealer would be the holder of the lease agreement and they shit the bed.

No chance this dealer wants to hold the contract and collect the payments LOL.
