There’s no need for a lawyer. Just be reasonable, but firm. Asking for the exact car you want, same pricing terms (with some added discount or bonus options), and a loaner until the car arrives seems fair and reasonable. Like others have said, get everything in writing and deal ONLY with senior management at this point.

Follow the contract you have, drive the car, send the checks, let them take you to court.

(just as Judge Judy, "if it is not in the contract, I don't want to hear about it.")

thats wild for sure.

go online, do your research- find a dealer with the exact car you want with exact options, and make it their problem to bring it to you for the price you want/same price.

i would have them include free winter set of wheels for the convenience whatever deal you go with, or add a few more options to a build and tell them to make it happen.

make sure you park it indoor, before they come repo it in the middle of the night!

Something doesn't add up here. You couldn't complete a lease with an outstanding lien on the vehicle so if bmwfs is saying it's not them we aren't getting the full truth here. Unless they get you a car to your liking for the same price I'd just keep driving.

It doesn’t add up. I called bmw fs about the car again and they transferred to end of lease services. The car completed it’s early lease termination and it was all paid off. Going to talk the gm today.

diesel1879, what dealer is this by the way? I don't think you should feel bad about putting them on blast here.

This sounds like somebody sold you a car that was "promised" to somebody else for MORE money. IE One salesman sold you the car, another one who may have been on vacation and had another person lined up to buy the car for a higher price. Now they are stating they "were not authorized" to sell the car, cause they are trying to get it back from you, to make the higher price sale and get you to buy a different M5. The fact that BMWFS says the problem is on the dealers end makes me think this is the scenario.

That’s why we should see the listing and then someone on here should contact them and say they’ll take it at asking price or even over and see what they say .

If this is the case, the dealership is an utter joke.

I agree with last few posters. And in that case you are legally required to do nothing except tell the dealer to piss off. If you want to play nice, make sure you get something for your troubles. If they won't cooperate, walk away and enjoy your car!

wouldn't surprise me at all. had this happen with a house years ago. can't imagine some car salesmen would be any different than some real estate agents.

I think that’s exactly what happened. Now they are saying they will get me another one with lower miles (1k miles), one that has 10k more in options (only difference is interior is black) for the same price and it would be delivered this Friday. They also want the car back today. Could just be lying to get me into the dealership.

If you are interested in their offer, I wouldn't give them back the car until the new car is at the dealership. Clearly this dealership isn't being upfront and honest so I wouldn't trust them to honor the new deal if you give them your car back first.
