I just called and told them I will buy it right now over the phone.

They told me its actually £55k and not £25k.

I have on two occasions got BMW dealer to honour a pricing mistake with AUCs. Neither of them were anything like that far out of course. I believe that both had been listed at the price to them, which was c10% below the intended retail. I put down a deposit on them before they worked out their mistake. They subsequently tried to negotiate upwards, but I'm a heartless bastard

No. Even if you pay a deposit. Unless you have signed a binding contract that they will sell it too you.

I once saw an M3 advertised at standard M3 money by an independent garage, nothing out of the ordinary in the listing. The only thing was that it was a genuine 2003 CSL. Someone beat me to it as they sold it within 24 hours of listing. Soooo close as they were / are worth a fortune...

I'm not a lawyer, but a contract does not in general require a signature to become binding. You can for example make a verbal contract. I would have thought that speaking to a dealer, agreeing to buy, and paying them an agreed deposit would constitute some sort of contract. Whether there are circumstances in which the dealer can then refuse to honour the price is probably one for the lawyers.

In my last job, I would frequently make substantial binding contracts over the telephone, and very occasionally revert to a recording of the conversation if any dispute about the contract arose.

I wasn't answering that question I was merely pointing out that a price ticket or advertisement is not a binding offer.

But since you've asked, no you wouldn't get away with it in the example in the OP they'd stop the deal as soon as they realised, in fact it's moot point as it just wouldn't happen too many checks and balances.

Dont post here much but my wife just got a 4 series convertible

It was up on the used car site for 21k got a finance quote online then it gave a error and went upto 27k as per other 67plates of similar spec

Arranged to go see the car. The dealer (coopers) still had it on their site for 21k the next morning... Sales manager said if head office have priced it like that i will sell it for that price...

So dealers do sometimes honour mistakes granted this was only 6k and not 25k however

I remember buying some sofas on a clearly mispriced advert. Loads of people bought them online but I knew if I did that they'd wriggle out of it because of it being a web error.

I went into the store, placed the order with someone there who didnt really check what they was doing.

Everyone received the same message telling them it was a misprice and they was going to cancel the provisional orders. Fortunately about 3 of us (out of a few hundred) paid in store and had order confirmation.

They eventually gave in and honored the deal.

From a retail perspective unless the retailer attaches a price tag I believe when your putting in an offer to purchase which they’re not obliged to accept.

A contract is a legally binding voluntary agreement that is formed when one person makes an offer, and the other accepts it.

From the web - so probably utter bollocks - essentially when you have agreed a contract including verbally it's binding - other stat rights apply and I think with online pricing errors it's about if it's significantly different from similar items elsewhere

I think about 6 months after the F80/82 launch some US dealer site listed the MPE at about 1/2 price. Seemed like a whole load of the US guys jumped on the deal as it there was a Bimmerpost thread on it, and paid deposits over the weekend.

Some one had to write a lot of apologist emails to customer that Monday morning.

They can return your deposit. I don't think many people would take a dealership to court on an issue like this. Just the legal fees would put you out of pocket even if you win. Its an academic argument.
