Well here is a interesting warranty issue with BMW motorcycles. BMW can refuse warranty work for lack of use (low mileage). Here is how it is written: "Extreme lack of use (100 miles or less per month on average)".

If you do not ride at least 100 miles a month, BMW can refuse warranty work. I own a 2018 BMW R1200GSA and while it presently does not apply, I am currently around 100 miles a month. Interesting to say the least.

Thanks to everyone in the thread and who have sent me PM's wishing me well with the situation. Haven't been back on in a few and read back through the posts; It's always a good read and this did not disappoint.

With all of that being said, BMW NA agreed to replace the engine under warranty which I am grateful for. The new engine arrived at the dealer and goes under the knife tomorrow.

I will say what baffles me is the dealer bill is in excess of $80k right now and I would have to think the vehicle is worth around $90k? Why they didn't just salvage it and call it a day is beyond me. Car gets returned in 28 months when the lease is up...

I would assume that oem crate engine etc might list crazy high but the actual net cost to bmw might be less than half that. Again, just assuming. Also, I would imagine the replacement allows them to CPO the resale for a better dollar.

'Take it back' and do what with it? Find another customer? Would be difficult and you are already there.

$80k!? Holy fuck.

Let's be honest, though....they (BMW) likely get the engine and is able to do the labor for a fraction of that. Thus, it makes sense to replace it I suppose.....especially if it's a lease and they are getting it back.

BMW AG maintain a preset stock level of crated new engines for warranty work built into the overall cost of manufacturing the model.
So the actual cost of the engine itself is essentially negligible (in the sense that its there anyway and already paid for).
Dealer warranty work is generally set at a lower rate per hour than for customers.
So the actual cost to BMW AG won't be anywhere near $80k.
And at the end of the lease they have a car still worth trade money (or very close to it).

Looks like the engine is around 30K list plus whatever additional parts need to be replaced. Then add labor.

That's just the short block, that's a far cry from the complete package... and there ain't no chance in hell Im taking delivery of an M5 that some rando dealer tech rebuilt the engine on.

The consumer would be the plaintiff, but all he has to prove is that he has a legal contract (the warranty) and that BMW is violating it. BMW then has to prove that the failure in question was directly caused by an action or omission on the part of the consumer that voids the warranty per the language therein. BMW may very well have that proof in this case, but they can't just void a warranty in its entirety for lack of maintenance. They have to prove that lack of maintenance directly contributed to the failure.

EDIT: I see that BMW agreed to honor the warranty.

Just because everyone likes a good story...

After 4 1/2 weeks, I got my car back with the replaced engine block/turbos etc. After having the car for 4 days, it stumbled and shut off on me (3) times. I brought it to the dealer and they said they could not see any fault codes. They went on to explain that they contacted BMW NA and BMA NA was able to pull shadow codes showing that the fuel pumps were bad on the vehicle; 5 days later the fuel pumps were replaced.

Have had the vehicle for 5 days and it has now shut off on me (2) more times - rough idle, makes a sputtering noise when you press the gas after a cold start - fun times! BMW NA called me yesterday and offered me a reimbursement of (1) month's car payment but I would need to "sign a release" to which I politely declined and told them I already hired an attorney to lemon law the vehicle.

This has all been so disappointing to say the least as all I want to do is enjoy owning an M5.

Sorry to hear man. This rough idle issue is becoming a plague for this car. I have gone to dealer myself for it and they changed plugs and coils but didn't fix anything. I'm sure it's fuel pump issue but until car has no codes they won't do much.

Sad you have to hire an attorney. Bmw should want this car back. This thread alone will probably cost them more in the long run then just making things right with you.

Took 16 trips to service for GM to take my Escalade back. Sad these guys don’t have more pride in what they are selling especially at a six figure number.
