Exclamation Denied warranty because 1000 miles over "break-in service"

So where do I even start.... Previous M4 owner, moved over to an M5 competition in January - the car was purchased new, 169 miles on the odometer.

Day the car was delivered (purchased out of state), it had an SOS error so I had to bring it to the dealer to fix it. Drove the car fine and brought it in for break-in service around 2200 miles. Did the service no problem..

Car was due for it's first oil change - brought it into the dealer. When they brought the car out to me I noticed it was louder than normal but thought maybe the guy had it in s3 mode. I drove it about 100 feet to the stop sign and got a "mechanical failure" error message. Turned the car around and it sounded like when you get a utensil stuck inside of a garbage disposal. Car was at the dealer for over a week and I was told "the vehicle stopped making the noises and cannot find any fault codes/error" - They found some metal shavings in the oil filter but BMW NA said that was normal during the break in period.

Shortly after, I started having a problem where you turn the car on and it stumbles, then turns off. Problem became more frequent so I contacted the dealer. They had the car for a week and stated that BMW NA said the vehicle had to be reprogrammed. Gave me the vehicle back, worked fine for a couple of days and started stumbling again.

Yesterday, started the car and got a check engine light. Dropped the car off immediately at the dealer. From reading online, I was sure it was fuel pump since other members had the stumbling issue. Received a call today from the dealer stating that there was a "hard spot" found and BMW NA is denying warranty because the vehicle was brought in 1,000 miles past the "break in miles".

No software on the car, has been serviced at the same dealer since I purchased it and the vehicle only has 5,700 miles on it. I've owned every car brand under the sun and have never heard this non-sense. Car has been back 3x since the break-in service and has been "warrantied". Any BMW NA guys on here that can help out?

Appreciate any help / advice!

that sucks, but i am curious: why did you exceed the break in maintenance window by 1000 miles?

Other than the fact that I was never told the dire importance of doing so, this was during the entire pandemic - working from home and was not rushing to go into unnecessary places.

i would think it would be on them to prove that your actions caused the issues, vs "we just decided to deny warranty"

i'd also demand to see where it is IN WRITING that you signed that if you don't do the break in service exactly on time that it voids your warranty. and if it doesn't have to be exact then where IN WRITING does it say the allowable window ranges from! and of course, if this was an issue why was it never brought up by anyone to include BMW of NA until now after seeing the car several times after the break in period.

Not read your post OP (sorry I do that a lot on Bimmerpost) but from the tittle that seems really harsh!!

Good luck with the follow up. I know people will say you just should have following the RIS but 1000 miles over can at times be about 1 week of me not the appointment on time!

Ridiculous response from the dealer/BMW NA. I would call them back, tell them this is total BS, ask for proof of the delayed service causing the issue for which they are denying warranty, and let them know that you will be taking legal action if they do not honor their warranty.

I have a call into BMW NA and was told that within 2 business days someone would reach out to me; I've also spoken to an attorney who handles these kind of cases. It's pretty cut and dry IMO - the vehicle was brought in for the 1,200 mile service with 1,000 extra miles on it - they did not deny doing the service, charge me for the service nor did they state that my warranty was voided at the time that they performed the service. They continued doing warranty work after that service and I have the service documents.

I think I would say more than anything I am let down by BMW NA's position on this and the stress/aggravation it is causing for no reason. Fingers crossed.

None of these cars suffer that kind of serious issue from not going in right at the break-in mileage. That has to be nonsense. Good luck OP

What was the reason passing 1000mil over the recommend mileages?
Not saying they should void the warranty but I think they can if they want too.
Specially if they see you were reviving her in red.

my understanding is that M cars that have their BIS after 2000 miles can't be certified , but I have never heard that warranty denied for delaying that service
though having done multiple M school over the years and talked to multiple instructors and mechanics, they always do the break in service before they put the car in service for the school, so it seems BMW sticks to that religiously as it cost them money to run these cars for 1200 miles before using them

From my personal viewpoint while it is the dealer fault for not flagging and informing you that you have exceeded the break in service at 1200mi and you are at risk of having your warranty voided if there is any catastrophic failure with the engine.

BUT as with all M cars, there is a 1200mi break in service which is a manufacturer recommended service and over here in Asia, this is communicated to us when we first take delivery of our M Cars and that not performing this break in service, we are at risk of having our car warranty voided and thus we know the importance of the break in service.

For the F90, the engine oil, front and rear diff oils are changed as well as some inspection is done to ensure the new vehicle has no issues after this break in service. During this period before the break in service, the owner is advised not to bring the car up to more than 5000rpm and 100miles per hour which is actually stated inside the car manual.

Reading your post, it seems you only encountered the rough engine after the break in service at 2200mi, maybe this could be a point you can bring up as the vehicle experienced no rough engine issues before the break in service. It could be due to improper draining of engine oil or could be other issues and could also be just pure coincidence that the engine started having issues immediately after your break in service.

What I would do is, if the dealer is not helpful, would be to contact BMW NA and have a meet-up with them to discuss over this issue and have your vehicle be inspected by another of their authorized dealership for a 2nd opinion. And also in writing ask about the break in service whether it is so important that it can cause catastrophic failure if you service it after you exceed 1200mi. My opinion is that the engine should not experience catastrophic failure if you just exceed 1000mi.....if this is the case then BMW better lock up the vehicle operation once 1200mi is reached to prevent such incidents from recurring with their customers.

i know there are some extenuating circumstances right now with Covid, but you can't blame BMW for your negligence on the matter.. Sorry you had to learn this the hard way. The car even has the little yellow indicator that notifies you for service.. lol
