If you just brought it in for an oil change or routine maintenance and it wasn't hooked up it would be fine, and if you flashed it back to stock before any warranty work you'd presumably also be fine...but it's still a risk regardless. There's no 100% guarantee that they wouldn't be able to detect that you've modified the DME. If you're not comfortable risking your warranty don't flash the car. Plain and simple.
