"There you can state your claim. Its not fair to you." Why is it not fair. The buyer of a used car can check proper service before purchase. I declined a used car buy exactly for this reason. BMW knows that cars that have not had this service are more likely to have a warranty claim, so they would prefer not to cover. Its not like they took his money and then declined. As for the ecu tune, if the tune caused the problem then they do not have to cover. The buyer should have asked the seller, and if the seller lied then depending on the laws of the state, the buyer may have a claim.
