According to the dealer, BMW NA is who said “no warranty” and suggested I call BMW NA myself and speak to them.

How your car issues were communicated to BMW NA, we would never know. The way your case was presented, information, etc as well as what kind of opinions they made when they communicated with bmw NA would greatly affect bmw na's opinion of your case.
Still feel you should go straight to bmw NA direct instead of through your current dealer.
