That's not typically how a lemon law works, most states require a mfg. to apply a “reasonable number of attempts” to repair the car. This is a single occurrence and although it will take the car out of their hands for over 30 days, that does not automatically garner a lemon law status.

Speak to a lemon law lawyer and see what they say. I don't think this would qualify but I am also not an attorney.
