I would absolutely keep it! I also have an 07 328i and love it to death! Mine has 60k miles on it and never had any problems! Not CPO. Only replaced normal wear and tear. I know what you mean about the transmission, unfortunately 328's didn't get the best auto tranny and I also had mine reset and I feel like it slips into 6th every chance it gets! lol
